}-CHAPTER 240 NATIONAL SECURITY (98-025){{br{}{L{I
{{br{}{L{I240.1 The name of this Act shall be the
National Security Act 1998 and its purpose shall b
e to provide a mechanism, in the form of a Nationa
l Security Commission of Cyberia, to conduct intel
ligence, counterintelligence, civil defence and em
ergency relief activities on behalf of the Governm
ent of Cyberia.{{br{}{L{I{{br{}{L{I240.2 There sha
ll be established a National Security Commission o
f Cyberia, which shall consist of three National S
ecurity Commissioners appointed by the President,
the Minister of Defence and the Minister of the In
terior, subject to approval by a majority of the S
enate.{{br{}{L{I{{br{}{L{I240.3 Duties. The duties
of the National Security Commission shall be as f
ollows:{{br{}{L{I{{br{}{L{I1) To conduct intellige
nce and counterintelligence activities on behalf o
f the Government of Cyberia.{{br{}{L{I{{br{}{L{I2)
To coordinate civil defence activities and measur
es in the Virtual Commonwealth of Cyberia.{{br{}{L
{I{{br{}{L{I3) To coordinate disaster relief and e
mergency measures in the Virtual Commonwealth of C
yberia.{{br{}{L{I{{br{}{L{I240.4 Powers. The power
s of the National Security Commission shall be as
follows:{{br{}{L{I{{br{}{L{I240.41 The National Se
curity Commission shall have the power to conduct
espionage activities in foreign nations only on th
e order of the President of Cyberia, with the advi
ce and consent of the National Assembly.{{br{}{L{I
{{br{}{L{I240.42 The National Security Commission
shall have the power to conduct counterespionage a
ctivities in the Virtual Commonwealth of Cyberia o
nly on the order of the President of Cyberia, with
the advice and consent of the National Assembly.
{{br{}{L{I{{br{}{L{I240.43 In the event of the Pre
sident of Cyberia declaring a national or regional
emergency, the National Security Commission shall
have the power to organise and coordinate civil d
efence and/or disaster relief efforts and measures
for the duration of the emergency.{{br{}{L{I{{br
{}{L{I240.5 Restrictions. The powers of the Nation
al Security Commission shall be restricted as foll
ows:{{br{}{L{I{{br{}{L{I240.51 The National Securi
ty Commission shall not, in the pursuance of any o
f its duties, engage in political assassinations o
r any other form of terrorist activity or any acti
vity designed to politically destabilise any sover
eign nation, unless the nation in question is form
ally at war with the Virtual Commonwealth of Cyber
ia. The gathering of intelligence from classified
foreign sources shall not be construed as an activ
ity designed to politically destabilise a sovereig
n nation for the purposes of this Act.{{br{}{L{I{{
br{}{L{I240.52 In the performance of any and all o
f its duties where Cyberian citizens are involved,
the National Security Commission shall strictly o
bserve any and all Constitutional protections enjo
yed by said Cyberian citizens.{{br{}{L{I{{br{}{L{I
240.53 All the Commissioners are subject to remova
l by either the President or the Minister who appo
ints them and also to impeachment by the Senate as
provided for in the Constitution.{{br{}{L{I{{br{}
{L{I240.6 Organisation. The organisation of the Na
tional Security Commission shall be as follows:{{b
r{}{L{I{{br{}{L{I240.61 The Commissioner appointed
by the President shall be the High Commissioner o
f the National Security Commission and shall presi
de over the proceedings of the Commission. The Hig
h Commissioner also shall have the power to overru
le or modify the acts of either of the two lower C
ommissioners.{{br{}{L{I{{br{}{L{I240.62 The Commis
sioner appointed by the Minister of Defence shall
be the Head of the Bureau of Intelligence and Coun
terintelligence and shall be charged with conducti
ng intelligence and counterintelligence activities
as provided for by this Act.{{br{}{L{I{{br{}{L{I2
40.63 The Commissioner appointed by the Minister o
f the Interior shall be the Head of the Bureau of
Civil Defence and Emergency Management and shall b
e charged with conducting civil defence and emerge
ncy relief activities as provided for by this Act.
{{br{}{L{I{{br{}{L{I240.7 Funding. The National Se
curity Commission shall be funded equally as parts
of the budget of the Ministries of Defence and th
e Interior and such funding shall be included by t
he President in his/her annual budget request.{{br
{}{L{I{{br{}{L{I240.8 Severability. In the event t
hat any portion of this Act is found by the Courts
to be unconstitutional, such portion shall be sev
erable from any portions of the Act not included o
r dependent upon the portion found unconstitutiona
l, all of which shall retain full force of law.{{b
r{}{L{I{{br{}{L{ICHAPTER 250 - PRESIDENTIAL SUCCES
SION (98-036){{br{}{L{I{{br{}{L{I250.1 In the case
of a presidential vacancy, or whenever the Presid
ent is out of easy and effective communication, th
e order of succession and interim succession to th
e President is:{{br{}{L{I{{br{}{L{I1) the Vice-Pre
sident{{br{}{L{I{{br{}{L{I2) the Speaker of the Ch
amber{z{{br{}{L{I{{br{}{L{I3) the President pro te
mpore of the Senate{z{{br{}{L{I{{br{}{L{I4) the Ch
ief Justice of the Supreme Court{z{{br{}{L{I{{br{}
{L{I5) the Deputy Speaker of the Chamber{z{{br{}{L
{I{{br{}{L{I6) the Deputy President pro tempore of
the Senate{z{{br{}{L{I{{br{}{L{I7) the Deputy Chi
ef Justice of the Supreme Court{z{{br{}{L{I{{br{}
{L{I8) the Ministers in such order as the Presiden
t may direct.{{br{}{L{I{{br{}{L{I250.2 Until other
wise provided by law the Deputy Chief Justice must
be designated from among the Associate Justices o
f the Supreme Court by the Chief Justice.{{br{}{L
{I{{br{}{L{ICHAPTER 260 - ARMED FORCES AND DEFENSE
{{br{}{L{I{{br{}{L{I260.1 The name of this Act is
the 'Cyberian Armed Foces and Defense Act of 2002.
{{br{}{L{I{{br{}{L{I260.2 The armed forces of Cybe
ria consist of the Cyberian Defense Force (CDF). T
he CDF consists of land, air, and naval units.{{br
{}{L{I{{br{}{L{I260.2.1 No other armed force, orga
nized for the purpose of national defense (except
for provincial militias), is authorized to operate
in Cyberia.{{br{}{L{I{{br{}{L{I260.3 The Minister
in charge of the CDF on behalf of the Government
is the Minister of Defense.{{br{}{L{I{{br{}{L{I260
.3.1 The supreme command level of the CDF is the C
DF Chief of Staff. CDF Chief of Staff is subject t
o the authority of the Government and is subordina
te to the Minister of Defense. The CDF Chief of St
aff shall be appointed by the Government upon reco
mmendation of the Minister of Defense.{{br{}{L{I{{
br{}{L{I260.3.2 The CDF is, at all times, subordin
ate to the control of legal civil authorities.{{br
{}{L{I{{br{}{L{I260.4 Chapter 553 of the Cyberian

}+{{br{}{L{ICHAPTER 260 - ARMED FORCES AND DEFENSE
{{br{}{L{I{{br{}{L{I260. 1 GOVERNING PRINCIPLES Th
e following principles govern national security in
this Commonwealth:{{br{}{L{I{{br{}{L{INational se
curity must reflect the resolve of Cyberians, as i
ndividuals and as a nation, to live as equals, to
live in peace and harmony, to be free from fear an
d want and to seek a better life.{{br{}{L{I{{br{}
{L{IThe resolve to live in peace and harmony precl
udes any Cyberian citizen from participating in ar
med conflict, nationally or internationally, excep
t as provided for under the Constitution or law.{{
br{}{L{I{{br{}{L{INational security must be pursue
d in compliance with the law, including internatio
nal law.{{br{}{L{I{{br{}{L{INational security is s
ubject to the authority of the National Assembly a
nd the President.{{br{}{L{I{{br{}{L{I260. 2 SECURI
TY SERVICES 260. 21 The security services of the C
ommonwealth consist of the Cyberian Defence Force,
the provincial guards and the federal and provinc
ial police.{{br{}{L{I{{br{}{L{I260. 22 The CDF and
the provincial guards are the only lawful militar
y forces in the Commonwealth.{{br{}{L{I{{br{}{L{I2
60. 23 Other than the security services establishe
d under this Chapter, armed groups may be establis
hed only by law.{{br{}{L{I{{br{}{L{I260. 24 The se
curity services must act, and must teach and requi
re their members to act, in accordance with the Co
nstitution and the law, including customary intern
ational law and international agreements binding o
n the Commonwealth.{{br{}{L{I{{br{}{L{I260. 25 No
member of any security service may obey a manifest
ly illegal order or be punished or prejudiced for
disobeying a manifestly illegal order.{{br{}{L{I{{
br{}{L{I260. 26 Neither the security services, nor
any of their members, may, in the performance of
their functions prejudice a political party intere
st that is legitimate under the Constitution{z or
further, in a partisan manner, any interest of a p
olitical party.{{br{}{L{I{{br{}{L{I260. 3 CDF The
CDF must be structured and managed as a discipline
d military force. The object of the CDF is to defe
nd and protect the Commonwealth, its territorial i
ntegrity and its people in accordance with the Con
stitution and the principles of international huma
nitarian law.{{br{}{L{I{{br{}{L{I260. 4 POLITICAL
RESPONSIBILITY 41 Only the President may authorise
the deployment of the CDF in co-operation with th
e police service{z in defence of the Commonwealth
{z or in fulfilment of an international obligation
.{{br{}{L{I{{br{}{L{I260. 42 When the CDF is deplo
yed, the President must inform the National Assemb
ly, promptly and in appropriate detail, of the rea
sons for the deployment of the CDF{z any place whe
re the force is being deployed{z the number of peo
ple involved{z and the period for which the force
is expected to be deployed.{{br{}{L{I{{br{}{L{I260
. 43 A Minister must be responsible for defence.{{
br{}{L{I{{br{}{L{I260. 5 COMMAND OF CDF 260. 51 Th
e President is commander-in-chief of the CDF and o
f the provincial guards when they are called into
the service of the Commonwealth.{{br{}{L{I{{br{}{L
{I260. 52 Command of the CDF must be exercised in
accordance with the directions of the Minister res
ponsible for defence, under the authority of the P
resident.{{br{}{L{I{{br{}{L{I260. 53 Subject to th
e authority of the President and the Minister, the
Chief of Defence Staff has the operational comman
d of the CDF.{{br{}{L{I{{br{}{L{I260. 6 REGULATION
S The President may make regulations implementing
this Chapter, subject to legislative disallowance

nours (except Emeritus President, Friend and Ally
of the Cyberian people, military ranks, academic d

f membership in the order are:{{br{}{L{ICompanion

{L{I330.23 The senate of the order is its governin
g body. The senate is to comprise the President, D
eputy President, Speaker, any Emeritus President a
nd any Companion of the Order. The President is ex

{I330.3 EMERITUS PRESIDENT The National Assembly,
on the recommendation of the order, may confer the
title of emeritus president on any former preside
nt. The title is hereby conferred on President Ken
