CYBERIAN FEDERAL CODE
TITLE III - THE LEGISLATIVE BRANCH
CHAPTER 300 - GENERAL

300.1 Article 4 of the Constitution provides for the National Assembly.

300.2 This Title provides for the rules and procedures of the National Assembly, but these rules are not subject to presidential veto.

300.3 Title VII of the Federal Code provides for legislative elections.

CHAPTER 310 - Speaker

310.1 The National Assembly must, before proceeding to the despatch of any other business, elect a deputy to be the Speaker of the Assembly, and as often as the office of Speaker becomes vacant the Assembly shall again elect a member to be the Speaker.

310.2 The Speaker shall cease to hold office if they cease to be a deputy. They may be removed from office by a vote of the assembly, or may resign office by writing addressed to the President.

310.3 Before or during any absence of the Speaker, the National Assembly may elect a deputy to act as speaker during the absence.

310.4 The Chief Justice must preside at any election for speaker. Nominations must be open for 72 hours and no longer, the poll must commence immediately that nominations close, and voting in the poll must be for 72 hours and no longer. The election must be by STV.

310.5 The National Assembly may also elect a Speaker by unanimous consent.

310.6 The Speaker is not to adjourn the assembly, or do anything else as presiding officer and servant of the assembly, without the prior consent of the deputies. Any question arising in the assembly is to be decided by the assembly.

Chapter 311 ENACTMENTS

311.1 DEFINITIONS 'Bill' means a proposed law and 'item' means anything else which the assembly can pass.

311.2 OPEN DEBATE The complete text of every bill or item (including any proposed amendments) must be posted to the assembly.

311.3 COURTESIES RULE Deputies and other participants in the assembly must use the traditional parliamentary courtesies, titles and forms of address in debate.

311.4 RELEVANCE RULE Any post (other than a parliamentary question) in the assembly must be relevant to a bill or item before the assembly. Parliamentary questions are not debatable. Previous votes of the assembly in the current legislative term are not debatable except in terms of a motion for their repeal or consideration of a presidential veto.

311.5 ALLEGATIONS Allegations of incapacity, negligence, misconduct or improper motives are not debatable except in terms of a substantive motion allowing a separate and distinct vote on each allegation.

311.6 TIMETABLE

311.61 Every bill or item must be before the assembly for not less than 7 days before being put to the vote.

311.62 Amendments to a bill or item must be moved within 7 days of introduction or have the sponsor's consent.

311.63 The assembly must vote upon all amendments and procedural motions with respect to a bill or item before voting on final passage.

311.64 Any deputy may extend the timetable for a bill by 7 days, but only once in respect of any bill.

311.65 The assembly may reduce or extend the timetable with respect to a particular bill before it by unanimous consent.

311.66 A bill with respect to suffrage, elections or proportional representation may not be introduced in the month preceding an election save by unanimous consent.

311.7 PLAIN ENGLISH Every bill must be in plain and clear English which any Cyberian can understand.

311.8 HOW TO CONDUCT A POLL Every poll must continue for 72 hours and no longer. Every poll must be set to close automatically if that is possible. Every poll must include the text of the question, or if that is not possible, the speaker must add the text of the question to a reply message to the notice of the poll.

311.81 UNANIMOUS CONSENT If a deputy or another participant in the National Assembly requests unanimous consent to a bill or item and there is no objection within 72 hours it passes without being polled. An objection may be withdrawn. Any request for unanimous consent must either-

311.811 be sent in a message separate to any new motion, bill or item; or

311.812 if the Assembly conducts its business using e-mail, be sent in the same message as the bill or item it relates to, with the words "unanimous consent" in the subject line.

311.82 MAJORITY CONSENT If a number of deputies that exceeds half of the number of positions in the current National Assembly consent to a bill or item, and a deputy or another participant in the National Assembly has moved that it pass by majority consent, it passes 72 hours after the motion without being polled. A deputy introducing a bill or item may indicate their consent to it in the same message. If the Assembly conducts its business using e-mail, a motion that a bill or item pass by majority consent must be sent in a message separate to any new motion, bill or item. A consent may be withdrawn.

311.9 HOW TO OVERRULE THE SPEAKER The assembly may overrule a decision of the Speaker by simple majority. Once a motion to overrule is introduced the ruling in question is suspended until the assembly votes on the motion to overrule. Debate on a motion to overrule is restricted to the legality of the ruling.

11.10.1 Posting Of Bills
The speaker must post every bill or resolution of the house in an assembly blog published for the purpose, with the full text and a record of the voting, within 48 hours of being voted by the house. The same rules with respect to contributions apply to the assembly blog as to the CBC blog.

311.10.2 POSTING OF LAWS The president must cause the text of every law (including laws for the amendment of the constitution) to be posted to the Commonwealth website within 48 hours of final passage.

311.11 PARTICIPATION Participants in the assembly who are not deputies are subject to the rules of procedure in the same way as deputies and may be admonished, punished, suspended or expelled for breaches of the rules or legislative contempts in the same way as deputies.

330.1 MERIT There is to be a Cyberian honours system administered by the Order of Cyberia. Any honour must be awarded for exceptional service, not just holding a particular office.

330.2 ORDER OF CYBERIA
330.21 All Cyberian honours (except Emeritus President, Friend and Ally of the Cyberian people, military ranks, academic degrees,legislative citations) are to be awarded by the order.

330.22 The grades of membership in the order are:

Officer
Member

330.23 The senate of the order is its governing body. The senate is to comprise the President, Deputy President, Speaker, any Emeritus President and any Companion of the Order. The President is ex officio the chair of the order.

330.3 EMERITUS PRESIDENT The National Assembly, on the recommendation of the order, may confer the title of emeritus president on any former president. The title is hereby conferred on President Ken Kerns and President Jack Santucci.

330.4 FRIEND AND ALLY OF THE CYBERIAN PEOPLE The National Assembly may grant the honorary title of Friend and Ally of the Cyberian People to the chief of state of any micronation with which Cyberia has diplomatic relations.

330.5 CITATIONS The National Assembly may, by legislative act, issue legislative citations to any person for distinguished service to this Commonwealth. A citation must be in appropriate language and recite the services for which it is awarded.

330.6 REGULATIONS The senate of the order may make regulations implementing this chapter, subject to disallowance by the National Assembly within 14 days.
