CYBERIAN FEDERAL CODE
TITLE IX - CRIMINAL CODE
CHAPTER 900 - ADMINISTRATIVE

900.1 Title IX should be known as the Criminal Code. All statutes within Title IX shall be related to criminal law.

900.2 Title IX shall be organized according to the following numerical scheme:
Part I (910-919.999) - Criminal Procedure
Part II (920-929.999) - Criminal Jurisdiction
Part III (930-939.999) - Criminal Responsibility
Part IV (940-949.999) - Offenses Against the Commonwealth
Part V (950-959.999) - Offenses Against Democracy
Part VI (960-969.999) - Offenses Against Public Order
Part VII (970-999.999) - General Offenses

901.1 Denial of Rights
You commit this Class B offense if you (as a public official in any tier of government) deny to any Cyberian citizen rights guaranteed by Article 3 of the constitution.

CHAPTER 910 - Criminal Procedure : Fugitives (99-015, 99-017)

910.1 Anyone who fails to respond to a warrant of apprehension by entering an appearance before the issuing court within 14 days of being notified of the warrant is deemed to have resigned their citizenship.

910.2 Anyone deemed to have resigned under section 1 may not be readmitted as a citizen unless and until they answer the charges pending against them.

910.3 The period of 14 days under Section 1 is extended for anyone who satisfies the issuing court that they were unable to answer the warrant or were unaware of the warrant while the inability or lack of knowledge continued.

CHAPTER 911 - Criminal Procedure : Sentencing (99-102, 99-013)

CHAPTER 911 - Criminal Procedure : Sentencing (99-102, 99-013)

911.1 The penalty for a Class A offence is imprisonment for life.

911.2 The penalty for a Class B offence is imprisonment for 6 months.

911.3 The penalty for a Class C offence is imprisonment for 3 months.

911.4 The penalty for a Class D offence is imprisonment for 1 month.

911.5 The sentence on conviction of an offence may include in addition to or in substitution for a term of imprisonment, a fine equal to the income receivable by the offender during that term.

911.6 Anyone convicted of a Class A offence under this Code or of any offnce under Chapter 5 is disqualified from voting in any election held in Cyberia for 7 years.

CHAPTER 940 OFFENCES AGAINST THE COMMONWEALTH (98-007, 98-034, 99-013)

940.1 TREASON
You commit this Class A offence if, being subject to the jurisdiction of the Commonwealth, you levy war against the same or adhere to their enemies, giving them aid and comfort within the Commonwealth or elsewhere.

940.2 MISPRISION OF TREASON
You commit this Class A offence if, being subject to the jurisdiction to the Commonwealth and having knowledge of the commission of any treason against them, you conceal and do not, as soon as may be, disclose and make known the same to the President or to some judge of the Commonwealth, or to the governor or to some judge or justice of a particular Province.

940.3 REBELLION OR INSURRECTION
You commit this Class A offence if you incite, set on foot, assist, or engage in any rebellion or insurrection against the authority of the Commonwealth or the laws thereof, or give aid or comfort thereto.

940.4 SABOTAGE
You commit this Class A offence if you

940.4.1 knowingly and without the consent or knowledge of the authorised officer offer or accept any login, password or account giving you control of the Commonwealth forum, website or any official email group;

940.4.2 knowingly retain any such login, password or account after leaving office;

940.4.3 knowingly breach the terms of use of any web hosting or forum service with respect to any Commonwealth forum, website or official email group.

940.5 SEDITION
You commit this Class B offence if you, in any Province or Territory, or in any place subject to the jurisdiction of the Commonwealth, attempt to overthrow, put down, or to destroy by force the Government of the Commonwealth, or to levy war against the same, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the Commonwealth, or by force to seize, take, or possess any property of the Commonwealth contrary to the authority thereof.

940.6 ACTIVITIES AFFECTING ARMED FORCES DURING WAR
You commit this Class B offence if, when the Commonwealth is at war, you wilfully make or convey false reports or false statements with intent to interfere with the operation or success of the defence forces of the Commonwealth or to promote the success of its enemies; or you, when the Commonwealth is at war, wilfully cause or attempt to cause insubordination, disloyalty, mutiny, or refusal of duty, in the defence forces of the Commonwealth, or wilfully obstruct the recruiting or enlistment service of the Commonwealth, to the injury of the service or the Commonwealth, or attempt to do so.

940.7 RECRUITING FOR SERVICE AGAINST COMMONWEALTH
You commit this Class C offence if you recruit within the Commonwealth, or in any place subject to the jurisdiction thereof, to engage in armed hostility against the same; or open, a recruiting station for the enlistment of recruits to serve in any manner in armed hostility against the Commonwealth.

940.8 You commit a Class A offence if you issue or obey any order contrary to Chapter 260.

940.9 You commit a Class A offence if you establish an armed group contrary to Chapter 260.

940.10 You commit a Class B offence if you issue or obey any call for the CDF or any of its officers or members to disobey a lawful order.

CHAPTER 950 OFFENCES AGAINST DEMOCRACY - DEFINITIONS (99-017)

950.1 'Election' means any election held under law to fill any office or place of a public character and any referendum; and includes any election by either house of the National Assembly;

950.2 'Elector' means anyone entitled to vote at an election;

950.3 'Presiding officer' means the Electoral Commissioner, an expert tabulator or anyone appointed to assist the Electoral Commissioner in relation to the election.

CHAPTER 951 ILLEGAL PRACTICES (99-017)

951.1 You commit this Class D offence if you:

951.2 while prohibited by law from voting at an election, and knowing you are so prohibited, you votes at the election; or

951.3 procure anyone who is, and who you know is, prohibited from voting at an election to vote at the election; or

951.4 before or during an election, and for the purpose of promoting or procuring the choice of any candidate at the election, knowingly publish a false statement of the withdrawal of another candidate at the election; or

951.5 before or during an election, and for the purpose of affecting the return of a candidate at the election, knowingly publish a false statement of fact respecting the personal character or conduct of the candidate; or

951.6 being a candidate at an election, withdraw from being a candidate in consideration of a payment or promise of payment; or

951.7 being a candidate or the agent of a candidate at an election, corruptly procure any other person to withdraw from being a candidate at the election in consideration of any payment or promise of payment.

951.8 knowingly provide money for any payment which is contrary to this Chapter or for replacing any money which has been expended in any such payment; or

951.9 print, publish, or post any message with respect to an election which does not include the name and email address of the author.

CHAPTER 952 OTHER OFFENCES (99-017)

952.1 Impersonation
You commit this Class A offence if you vote or attempt to vote in, or register or attempt to register, the name of another person at an election, whether the name is that of a person living or dead or of a fictitious person.

952.2 Double voting
You commit this Class A offence if you vote or attempt to vote more than once at an election.

952.3 Bribery
You commit this Class C offence if you give, confer or procure, or promise or offer to give or confer or to procure or attempt to procure, to, upon or for any person any property or benefit of any kind on account of anything already done or omitted to be done, or to be afterwards done or omitted to be done

952.31 by an elector at an election in the capacity of an elector or in order to induce any person to endeavour to procure the return of any person at an election, or the vote of any elector at an election;

952.32 being an elector, ask, receive or obtain, or agree or attempt to receive or obtain, any property or benefit of any kind for himself or any other person on account of anything already done or omitted to be done, or to be afterwards done or omitted to be done, by them at an election in the capacity of an elector;

952.33 ask, receive or obtain, or agree or attempt to receive or obtain, any property or benefit of any kind for himself or any other person on account of a promise made by them or any other person to endeavour to procure the return of any person at an election, or the vote of any person at an election; or

952.34 advance or pay any money to or for the benefit of any other person with the intent that such money shall be applied for any of the purposes mentioned in this ection, or in discharge or repayment of money wholly or in part applied for any such purpose.

952.4 False answers to questions at elections
You commit this Class A offence if you:

952.41 wilfully make a false answer to any question which is lawfully put to you by the presiding officer, and which you are required by law to answer; or

952.42 being lawfully required to make a declaration before voting, you wilfully make a false declaration.

952.5 Breach of secrecy
You commit this Class A offence if you:

952.51 while a presiding officer, attempt to ascertain or discover, or aids in ascertaining or discovering, how anyone votes, except in the case of a person voting openly; or

952.52 as a presiding officer obtained knowledge or the means of knowledge of how someone has voted, disclose or aid in disclosing such knowledge otherwise than in answer to a question put in the course of proceedings before some court of competent jurisdiction is guilty of a Class A offence.

952.6 False claims
You commit this Class D offence if you:

952.61 make in a claim to be enrolled as an elector any statement which you know is false in any material particular; or

952.62 make, orally or in writing, to a court of competent jurisdiction a statement relating to the qualification of anyone as an elector which you know, false in any material particular.

CHAPTER 953 CITIZEN'S RIGHTS (99-017)

953.1 Proseuction
Any citizen may institute a prosecution for crimes committed under chapters 950-952 of the federal statutes.

CHAPTER 954 CRIMES AGAINST THE ADMINISTRATION OF JUSTICE

954.1 JUDICIAL CORRUPTION You commit this Class A offence if, as a judge, you solicit or accept a bribe or other improper reward, on account of anything already done or omitted or offered to be done or omitted in your judicial capacity.

954.2 PERJURY You commit this Class B offence if, in any judicial proceeding or for the purposes of instituting a judicial proceeding, you knowingly give evidence which is false in a material particular.

954.3 CORRUPTION OR INTIMIDATION OF WITNESSES You commit this Class B offence if you:

954.31 threaten, intimidate, restrain, or impede a person called or to be called as a witness in a judicial proceeding; or

954.32 give or offer a benefit of any kind to such a person as an inducement to perjury.

954.4 JUDICIAL BRIBERY You commit this Class B offence if you give, promise or offer a bribe or other improper reward to a judge in order to procure an act of judicial corruption.

954.5 CRIMINAL FACILITATION You commit a Class C Offence if you hide someone who has committed a crime, help their escape, destroy evidence concerning the crime, or in other like ways impede its discovery or prosecution.

954.6 ATTEMPTING TO PERVERT JUSTICE You commit this Class C offence if you attempt, in any way not specially defined in this Act, to obstruct, prevent, pervert, or defeat the course of justice in relation to any judicial proceeding.

954.7 CONTEMPT OF COURT The courts have inherent power to protect the integrity of their proceedings by punishing contempts, including the power to punish contempts in the face of the court summarily. Only the formulated rules of law apply to contempt of court.

CHAPTER 955 CRIMES AGAINST THE ECONOMY OF THE COMMONWEALTH

955.1 THEFT You commit this Class B offence if you unlawfully take what belongs to another with intent to acquire it, and the taking involves loss.

955.11 The theft is a Class C offence, if the court, taking account of the value of what is stolen and other circumstances of the crime, holds it petty.

955.12 The theft is a Class A offence if the court, taking into account whether the unlawful appropriation took place after intrusion into a dwelling, whether it concerned the appropriation of property borne by a person, whether the accused was equipped with a weapon, explosive or similar aid, or whether the act was otherwise of an especially dangerous or ruthless nature, concerned property of considerable value or entailed a keenly felt loss, holds it gross.

955.21 FRAUD You commit this Class B Offence if you by deception induce someone to commit or omit to commit some act which involves gain for the accused and loss for the deceived or someone represented by the latter. You also commit this Class B offence if you, by delivering incorrect or incomplete information, or by making alterations to a programme or recording or by other means, unlawfully affects the result of aut omatic data processing or any other similar automatic process so that gain accrues to the offender and loss is entailed by any other person.

955.21 The fraud is a Class C offence if the court, taking account of the extent of the loss and other circumstances of the fraud, holds it petty.

955.22 The fraud is a Class A offence if the court, taking account of whether the offender abused public trust or employed a false document or misleading bookkeeping, or whether the fraud otherwise was of a particularly dangerous nature, involved a substantial value or resulted in a keenly felt loss.

955.3 EXTORTION You commit this Class B o! ffence if you by unlawful coercion induce someone to do or not do something which involves gain for the offender and loss for the coerced person or someone represented by the latter.

955.31 The extortion is a Class C offence if the court, taking account of the extent of the loss and other circumstances of the fraud, holds it petty.

955.32 The extortion is a Class A offence if the court, taking account of whether the offender abused public trust or employed a false document or misleading bookkeeping, or whether the fraud otherwise was of a particularly dangerous nature, involved a substantial value or resulted in a keenly felt loss, holds it gross.

955.4 FORGERY You commit this Class C offence if you make or utter a false document representing any amount of the currency of the Commonwealth.

955.5 CORRUPT CONDUCT You commit this Class A offence if, as an officer of the Commonwealth or of the Reserve Bank of Cyberia, assist any person to commit a theft or fraud upon the Commonwealth. You can be convicted of this offence despite the failure to prosecute or convict any other person.
